Introduction
This Privacy Policy describes how beehiiv Inc. (“we,” “our,” “us,” or “beehiiv”) collects, uses, discloses, and otherwise processes personal information in connection with our website located at www.beehiiv.com (our “Website”), our own emails, and our products and services, including without limitation, those provided through the Website (together with the Website and our emails, our “Services”).
However, this Privacy Policy does not generally apply to our Services' processing of personal information solely on behalf of a beehiiv accountholder (a “Customer”), such as to allow a Customer to collect, store, use, disclose, or otherwise process personal information through the Services about their own contacts, subscribers, readers, and website visitors, etc. In most cases, the Services process that information on behalf of and under the instructions of the applicable Customer, and that Customer's own privacy policies or practices apply to that processing. For those processing activities, we act as our Customer's “processor” or “service provider” under applicable law, and not as a “controller” or other independent business. That said, this Privacy Policy does apply to certain processing activities in which we act on our own behalf with respect to information processed through the Services, including processing of personal information:
- to support the proper operation of the Services, such as by protecting the security, integrity, and availability of the Services;
- to monitor for and mitigate threats such as suspicious list activity, abusive sending practices, malicious content, denial-of-service activity, and other attacks on or through the Services;
- to otherwise detect, investigate, prevent, and respond to spam, abuse, unlawful activity, and other fraudulent use of the Services;
- to comply with applicable law, enforce our agreements and policies, and protect our rights and the rights of others; and
- to operate optional, opt-in features of the Services that involve beehiiv's own decision-making about measurement, targeting, personalization or certain other processing of personal information.
If you do not agree with our policies and practices, do not use our Services. By accessing or using our Services, you agree to this Privacy Policy. This Privacy Policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of our Services after we make changes is deemed to be acceptance of those changes, so please check this Privacy Policy periodically for updates.
1. Children Under the Age of 18
Our Services are not intended for children under 18 years of age. No one under age 18 may provide any information to or through the Services. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on or in our Services or on or through any of their features, including your name, address, telephone number, email address, or any screen name or user name you may use. If you believe we might have any information from a child under 18, please contact us at [email protected].
2. Information We Collect and How We Collect It
We may collect the following information about you:
a. Information You Provide to Us:
- Contact details, such as name, email address, phone number, job title, organization name, and business address;
- beehiiv login information, such as username and password;
- Information about your purchases and other business interactions with us;
- Information you provide when using or requesting details about our Services;
- Information you provide when requesting customer service or support;
- Information you provide in reviews or testimonials;
- Information you provide when you sign up or attend a virtual event;
- Information about your interests and preferences; and
- Any other information you provide to us.
You may provide information to be published or displayed (“posted”) on public areas of the Services or other information transmitted to other users of the Services or third parties (collectively with information you post, “User Contributions”). Your User Contributions are posted and transmitted to others at your own risk. Although we may currently limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Services with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.
Payments will be handled directly by a third-party provider (such as Stripe), and we will not receive full payment card numbers or similar details.
b. Cookies and Other Information Collection Technology:
We and third parties may collect information from your computer or other device by automated means such as cookies, web beacons, local storage, JavaScript, mobile-device functionality, and other computer code. This information may include unique browser identifiers, IP address, browser and operating system information, device identifiers (such as advertising identifiers), other device information, Internet connection information, as well as details about your interactions with the relevant website such as referring/exit pages, date and time of your visit, and error information, email or other online property (for example, the URL of the third-party website from which you came, the pages on our website that you visit, and the links you click on in a website or in an email). In some cases (such as cookies), the tools described here involve storing unique identifiers or other information on your device for later use. We use this information to enhance and personalize your user experience, to monitor and improve our Website and Services, and for other internal purposes.
You can find a list of cookies we use and information about them here. The cookies we use are designed to help you get the most from our Services, but if you do not wish to receive cookies, in addition to cookie selections you can make directly with us, most browsers allow you to change your cookie settings. Please note that if you choose to refuse cookies you may not be able to use the full functionality of our Services.
c. Information From Third Parties
We may also receive information from third parties, including affiliates, third-party sign-in platforms, technology vendors, and business information vendors, as well as other vendors and service providers. We may also receive information from publicly available sources.
d. Chat Information
When you engage with us using either our automated chatbot and/or direct messaging communication, we will record the conversation and information relating to your communications may be shared with our related service providers.
3. How We Use Your Information
We use personal information for the following purposes:
- to provide, manage, maintain, and improve our Services;
- to conduct business operations that support the Services, such as auditing, security, fraud prevention, invoicing and accounting, analytics, and research and development;
- to provide you with information, products, or services that you request from us and to process, fulfill, support, and administer related transactions or orders;
- to conduct non-sales/marketing communication with you, including to respond to your requests, provide notices, and notify you about certain changes to our Services or related offerings;
- to conduct sales and marketing, including to contact you regarding our services and third-party products, services, surveys, research studies, promotions, special events, and other subjects that may be of interest to you;
- to customize content, preferences, and advertising on our Website and elsewhere across the Internet;
- to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;
- to create aggregated or de-identified information;
- to address applicable laws, regulations, and legal processes, and to establish, exercise, or defend our legal rights;
- to fulfill any other purpose for which you provide the information or that we describe when the information is collected; and
- for any other purpose with your consent or authorization.
The data protection laws of the United Kingdom and European Economic Area require companies to explain the basis on which they process personal information under those laws. Where those laws apply, our legal bases are as follows:
- In some cases (such as certain situations described by C, D, and G in the list above), our processing of personal information is necessary for us to comply with a contract with you (such as our Terms of Use) or to take steps in anticipation of entering into a contract with you.
- In other cases (such as certain situations described under I in the list above), we process personal information because we are required to do so by laws in jurisdictions such as the United Kingdom and countries in the European Economic Area.
- In certain cases, we process personal information based on your consent, such as certain situations covered by E, F, and K in the list above, and in some cases aspects of A, B, C, or D, depending on the circumstances and the applicable law. When we process personal information on the basis of consent, it may be express consent or implied consent, depending on the situation and on which laws apply.
- We may also process personal information where we believe it is necessary for purposes of our legitimate interests (primarily growing, maintaining, improving, marketing, and protecting our business and Services) or the legitimate interests of others. Depending on the circumstances and applicable law, this may include processing described in A–J, including certain processing for sales and marketing purposes described in E and certain customization, preference, and advertising activities described in F.
- And in some countries outside the United Kingdom and European Economic Area, we process personal information on additional or other grounds permitted by applicable law.
4. Disclosure of Your Information
Some features of our Services let you disclose personal information yourself. For example, some features let you sign up for a beehiiv Customer's newsletter (i.e., disclosing your name and email address to that Customer) or receive other content, and some features allow you to post content publicly.
beehiiv itself may disclose information:
- to beehiiv affiliates for the purposes described in this Privacy Policy;
- to business partners and vendors;
- to vendors, contractors, and service providers we use to support our business, such as third parties providing IT and infrastructure support services, and ordering, advertising, marketing, and payment processing services;
- to Customers as part of certain features of the Services;
- to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which information held by beehiiv is among the assets transferred;
- to other third parties to fulfill the purpose for which we requested or you provided the information;
- to comply with any court order, law, or legal process, and to respond to appropriate government or regulatory requests;
- to enforce or apply our Terms of Use and other agreements, including for billing and collection purposes; and
- if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of beehiiv, our Customers, or others (including exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction); and
- in other cases with your consent or authorization.
It is possible that at any given moment, our service providers, contractors or vendors could host or operate any aspects of our business, potentially including mechanisms through which we send or receive communications, such as certain email systems, call centers, websites, applications, or components of any of them. In those cases, vendors, contractors and service providers engaged in this manner may collect information from you directly when you communicate or interact with us, even in certain situations where only beehiiv branding appears.
We may use and disclose appropriately aggregated or de-identified information for any purpose.
5. Self-Service Choices and Options
We offer some self-service mechanisms:
- Report spam or other abuse of the Services by a Customer. Please report this at https://www.beehiiv.com/report_abuse.
- Global opt-out from your current subscriptions to beehiiv Customer newsletters. If you would like to submit a global request to be unsubscribed from all newsletters that Customers currently send you through the beehiiv platform, email us at [email protected]. Please send the request from the email address at which you are receiving those newsletters. This request may not affect newsletters or other emails that those Customers send you from outside of the beehiiv platform. To make any other requests regarding a Customer's handling of your personal information or regarding beehiiv's handling of your personal information on behalf of a Customer, please contact the Customer directly. beehiiv is not responsible for Customers' decisions regarding your personal information.
- Unsubscribe from beehiiv's own Marketing Emails. You can opt out of receiving beehiiv's own marketing emails at any time by clicking the unsubscribe link in them or by emailing us at [email protected]. This opt-out does not apply to service-related announcements, transactional messages, or messages sent by Customers.
- Cookie choices. When you first visit the Website, you will be presented with a popup message granting you choices regarding cookies. Additionally, your browser may also offer a way to activate the Global Privacy Control signal (“GPC”) and we comply with the GPC. The cookies we use are designed to help you get the most from our Services, but if you do not wish to receive cookies, most browsers allow you to change your cookie settings. Please note that if you choose to refuse cookies you may not be able to use the full functionality of our Services.
- In-account preferences. If you have an account with our Services, you may have additional options available in your account settings.
6. Your Rights Regarding Your Information
Depending on which laws apply in particular situations, residents of certain jurisdictions have certain legal rights with respect to personal information we handle about them.
a. U.S. State Privacy Rights (other than California)
Residents of California should review the Privacy Details for California Residents section further below for details about their rights under California law.
Depending on where you reside and subject to applicable law, you may have the following rights:
- obtain confirmation of whether we process personal information about them;
- obtain access to, and in some cases a copy of, the personal information we hold about them;
- obtain a copy of certain personal information in a portable and, to the extent required by law, readily usable format;
- correct inaccuracies in their personal information;
- delete certain personal information; and
- exercise any other rights made available under applicable law.

Residents of certain states may also have the right to opt out of certain processing activities, including targeted advertising, sale of personal information, and profiling in furtherance of decisions that produce legal or similarly significant effects. Information about those choices is provided below.
b. Privacy Rights Outside the United States
Where our handling of your personal information is subject to the laws of the European Union or United Kingdom, or similar data protection laws, you have certain rights to do the following:
- obtain confirmation of whether we hold personal information about you, and receive information about how it is used and disclosed;
- obtain access to and a copy of the personal information we hold about you;
- update, correct, or delete the information;
- obtain a restriction on the use of the information;
- object to the use or disclosure of the information, including for direct marketing purposes;
- receive certain personal information in a structured, commonly used, and machine-readable format, and in some cases have that data transmitted to another controller; and
- withdraw consent previously provided for the handling of the data, without affecting the lawfulness of prior use and disclosure of the data.
You also have the right to file a complaint with the relevant supervisory authority, but we respectfully invite you to contact us first, as we would like to do our best to resolve any concern you may have.
c. Exercising Your Rights
Californians should follow the instructions in the Privacy Details for California Residents section further below.
Residents of certain U.S. states may have the right to opt out of the “sale” or “sharing” of their personal information for cross-context behavioral advertising purposes under those states' laws. If you believe you have such rights and would like to exercise them, please email us at [email protected].
If you wish to exercise any of the other rights mentioned above, or would like information regarding rights that may be available to you under applicable law, please email us at [email protected].
Where permitted by law, we may take reasonable steps to verify your identity and your request, including by verifying information associated with your account, the email address you provide, or your state or country of residence.
Authorized agents may submit requests on behalf of individuals where specifically authorized by applicable law. If you are an authorized agent submitting a request on behalf of another individual, we may require proof of your written authorization and may also require us to verify the individual directly, as permitted by applicable law.
d. Additional Information About Rights Requests
Many of the rights described above are subject to limitations or exceptions under applicable law. For example, we may decline a request where necessary to comply with law, protect our rights or the rights of others, maintain security, or complete a transaction or provide a service requested by you.
We may also need certain information in order to provide the Services to you. If you ask us to delete it, you may no longer be able to use some or all of the Services.
e. Appeals
Residents of certain U.S. states may have the right to appeal our decision regarding a privacy request. If you believe you have such a right and would like to submit an appeal, please email us at [email protected] and include “Privacy Rights Appeal” in the subject line, the email from us containing the decision you are appealing, and the reason for your appeal.
7. International Data Transfers
We are headquartered in the United States, and the recipients of the disclosures described in this Privacy Policy are located in the United States and elsewhere in the world, including in countries where privacy laws may not provide the same level of protection as the laws of the country where you live. However, this Privacy Policy applies to beehiiv's processing of personal information worldwide. beehiiv complies with applicable legal requirements for protecting personal information transferred across borders, including through the use of regulator-approved Standard Contractual Clauses where appropriate. If you wish to request information about the transfer mechanisms beehiiv uses for relevant transfers of personal information to third parties, you can contact us.
Customers may also use our Services to transfer personal information to beehiiv or to others across borders in connection with their own use of the Services. In those cases, the Customer is responsible for determining the legal basis and transfer mechanism for its own transfers, including where applicable reliance on Standard Contractual Clauses or other legally recognized transfer tools.
8. Data Security
We have implemented certain measures as part of an effort to help secure your information from accidental loss and from unauthorized access, use, alteration, and disclosure. Unfortunately, no information transmission or storage method is completely secure. We cannot guarantee the security of your information. Any transmission of information is at your own risk.
The safety and security of your information also depends on you. Where you have chosen a password for the use of our Services, you are responsible for keeping this password confidential, and you may not share your password with anyone.
9. Changes to Our Privacy Policy
We may change this Privacy Policy prospectively at any time. It is our policy to post any changes we make to our Privacy Policy on this page with a notice that the Privacy Policy has been updated on the Website's home page. If we make material changes to how we treat personal information, we will comply with any applicable legal obligation to notify you by email to the email address specified in your account and/or through a notice on the Website's home page. The date this Privacy Policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Website and reviewing this Privacy Policy to check for any changes.
10. Retention
We will retain personal information until after we determine that we no longer need it to fulfill the purposes outlined in this Privacy Policy, unless the law requires us to keep it for a longer period of time. To provide security and business continuity for the activities described in this Privacy Policy, we make backups of certain data, which we may retain for longer than the original data.
11. Privacy Details for California Residents
This section supplements (and sometimes repeats) the other information contained in our Privacy Policy and applies solely to residents of California. Data about individuals who are not residents of California is handled differently and is not subject to the same rights described in this section. Most of this section is intended to address the amended California Consumer Privacy Act and its regulations (together, the “CCPA”).
a. Collection, Retention, and Use of California Personal Information
In CCPA terms, during the 12 months leading up to the effective date of this Privacy Policy, beehiiv collected the categories of personal information described below. beehiiv continues to collect this information:
- Identifiers, such as name, email address, phone number, business address, username, online identifiers, IP address, device identifiers, cookie identifiers, and similar identifiers.
- Commercial information, such as information about purchases and other commercial or business interactions with us.
- Internet or other electronic network activity information, such as browsing information, referring and exit pages, date and time of visits, links clicked, email interaction information, error information, and information regarding your interactions with our websites, emails, and other online services.
- Geolocation data, such as general location information inferred from IP address or internet connection information.
- Professional or employment-related information, such as job title, organization name, business contact details, and similar business-profile information.
- Sensitive personal information, specifically account log-in, in combination with any required password or credentials allowing access to an account, such as your beehiiv username and password.
- Inferences drawn from the personal information we collect, such as inferences about your interests and preferences.
We generally retain your information until after we determine we no longer need it for the purposes described in this Privacy Policy. In determining how long to retain information, we consider the amount, nature and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of the information, the purposes for which we process the information, applicable legal requirements, and our legitimate interests. Because we may collect and use the same category of personal information for different purposes and in different contexts, there is no general fixed retention period that always will apply to a particular category of personal information.
beehiiv uses personal information for the following purposes:
- to provide, manage, maintain, and improve our Services;
- to conduct business operations that support the Services, such as auditing, security, fraud prevention, invoicing and accounting, analytics, and research and development;
- to provide you with information, products, or services that you request from us and to process, fulfill, support, and administer related transactions or orders;
- to conduct non-marketing communication with you, including to respond to your requests, provide notices, and notify you about certain changes to our Services or related offerings;
- to conduct sales and marketing, including to contact you regarding our services and third-party products, services, surveys, research studies, promotions, special events, and other subjects that may be of interest to you;
- to customize content, preferences, and advertising on our Services and elsewhere across the Internet;
- to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;
- to create aggregated or de-identified information;
- to address applicable laws, regulations, and legal processes, and to establish, exercise, or defend our legal rights;
- to fulfill any other purpose for which you provide the information or that we describe when the information is collected; and
- for any other purpose with your consent or authorization.
b. “Sales,” “Sharing,” and Other Disclosures
As described further below, some of our disclosures of personal information qualify under the CCPA as a “sale” of personal information (even if we don't receive money for it) or as a “sharing” of personal information for certain cross-context behavioral advertising purposes. During the 12 months leading up to the effective date of this Privacy Policy, we “sold” or “shared” the following categories of personal information to third parties: identifiers, internet or other electronic network activity information, and commercial information. The categories of third parties to whom we sold or shared those categories of personal information were advertising partners and analytics providers. This practice continues today. To our knowledge, we do not “sell” or “share” the personal information of individuals under 16 years of age.
You can exercise your right to opt out of those disclosures by emailing us at [email protected].
Your browser may also offer a way to activate the Global Privacy Control signal (“GPC”). The Website treats qualifying browsers for which the user has activated the GPC signal as having opted out of what CCPA calls a “sale” or “sharing” of any California personal information that is collected on that site from that browser using cookies and similar technology. You can override that treatment for a GPC-enabled browser by using the cookie controls available via the Cookie Preferences link to opt into particular categories of cookies from that browser. In that case, “sales” and “sharing” via cookies and similar technology in those categories may resume on that browser.
Opting out of “sales” and “sharing” limits only some types of disclosures of personal information, and there are exceptions to all of the rights described in this Section.
For example, during the 12 months leading up to the effective date of this Privacy Policy, we disclosed each of the categories of personal information identified above to various third parties for business purposes. The categories of recipients to whom we disclosed personal information for these purposes are set forth in the Disclosure of Your Information section earlier in this Privacy Policy.
c. CCPA Right to Access, Correct, or Delete Personal Information
If you are a California resident, California law allows you to request that we:
- Provide access to and/or a copy of certain information we have about you;
- Delete certain information we have about you;
- Correct certain personal information we have about you; or
- Inform you of the categories of personal information we have collected about you in the last 12 months; the categories of sources of such information; the business or commercial purpose for collecting, selling, sharing, or disclosing such information; the categories of third parties with whom we disclose personal information; and more specific detail about the categories of personal information we have sold or shared and disclosed for a business purpose, and the categories of recipients for those disclosures.
Certain information is exempt from such requests under California law. For example, we need certain information to provide our services to you, so we may reject a deletion request for that information while providing services to you.
To request to exercise any of these rights, please contact us at [email protected]. We reserve the right to take steps to verify your identity before responding to requests under this subsection of the Privacy Policy, but we will not normally require you to verify your identity to submit a request to opt out of “sale” or “sharing.”
We do not use or disclose “sensitive personal information” covered by this Privacy Policy and as defined in the CCPA in a manner that requires us to offer a special right to limit our use of this data under the CCPA due to its sensitive nature.
d. Requests Made by Agents
For security and legal reasons, we do not accept personal information requests that require us to use a third-party service (such as one operated by an agent) to view or respond to the requests. If you are an agent making a request on behalf of a consumer, we reserve the right to take steps to verify that you are authorized to make that request, which may include requiring you to provide us with written proof such as a notarized authentication letter or a power of attorney. We also may require the consumer to verify their identity directly with us. Because opt-out requests for sales made through cookies and related technology must be performed from each browser that is used to access our Services, it is easiest for the consumer to perform such opt-outs themselves. However, if a consumer wishes for an agent to perform browser-based requests on their behalf, the consumer may arrange for the agent to use the consumer's browser to make such requests. We are not responsible for the security risks of this or any other arrangements that a consumer may have with an agent. For clarity, this is not permission for any user to share their login credentials with an agent or any third party. Such sharing is prohibited and is not required for an agent to make requests under this Privacy Policy.
e. Nondiscrimination
You also have a right not to receive “discriminatory treatment” (within the meaning of the CCPA) or retaliation for the exercise of the privacy rights conferred by the CCPA.
f. California Shine the Light Law
California residents who are “customers” of beehiiv have the right to prevent beehiiv's disclosures of their “personal information” to “third parties” for those third parties' “direct marketing purposes” (each quoted term as defined under the California Shine the Light Law, Cal. Civ. Code § 1798.83). Such individuals may exercise this right at no cost by contacting us at [email protected] to opt out of certain disclosures of personal information under the CCPA and similar state laws. If you only wish to make a Shine the Light Law opt-out request and not a full CCPA sale/sharing opt-out request, please specify that when contacting us. If you also wish to make a complete CCPA “sale”/“sharing” opt-out request, please specify that when contacting us.
